This service agreement will be continued for a minimum period of (12) twelve months and authorizes Rove Pest Control (RPC) to access and perform service at the above property. After initial one year period, service will continue to be rendered until a written 30-day notice of cancellation is received. Any discounted initial treatment is given based on a minimum (12) month agreement. Therefore customer agrees to pay the difference between the standard and discounted initial service prices if the contract is cancelled prior to the expiration of the one year term. This transaction may be cancelled for any reason prior to midnight of the third business day after the date of this transaction.
This service does not include control or prevention of wood-destroying pests such as termites, or any other wood-destroying organisms. RPC shall not be liable for any claim for personal loss, bodily harm, property loss, or structural damage caused by pests. RPC will service both the interior and exterior of the property on the initial visit. During subsequent visits, RPC will follow the service plan chosen by the customer. If the customer’s service plan includes an interior service and the customer is not home, RPC will complete the exterior service and it will be the customer’s responsibility to contact RPC if they would like the interior service completed. This service would be completed at no extra charge.
Customer has agreed to RPC’s service plan. If between, regularly scheduled services the customer requests additional services, RPC will return and retreat the home according to the customer’s service plan. Customer understands that some plans require a service fee for additional services.
In the event of any dispute arising out of or relating to this agreement, the parties first agree to participate in at least four (4) hours of mediation in accordance with the commercial mediation rules of the American Arbitration Association (AAA) before having recourse to arbitration. If the mediation procedure provided for herein does not resolve any such dispute, the parties first agree that all disputes between the parties shall be finally resolved through arbitration before a panel of three (3) arbitrators under the AAA commercial arbitration rules. Furthermore, the parties expressly agree that this provision is made pursuant to a transaction involving interstate commerce and that their mutual rights and obligations and the conduct of any arbitration proceeding shall be controlled by the federal arbitration act. The arbitrators shall give effect to any and all waivers, releases, disclaimers, limitations, and other terms and conditions of this agreement. The arbitrators shall consider the legal defenses raised in the arbitration, and the decision of the arbitrators shall be final, binding, and may be entered and enforced in any court having jurisdiction in accordance with the federal arbitration act.
